The Supreme Court of Justice of the province of Santa Fe has prohibited the ground application of agrochemicals within 1,000 meters of the locality of Sastre. 

It emphasized that each community had a margin of appreciation within which the provincial law is considered tolerable. The decision from the highest court confirmed the ruling issued in 2020 when a first-instance judge prohibited spraying within a radius of a thousand meters from the urban line.

The ban is even more relevant given that Santa Fe is the second-largest agricultural production province in Argentina. The measure was challenged by the municipality of Sastre and the rural producers, as this locality is a hub for corn and soybean production.

"The fumigation of land with all types of agrochemicals is prohibited," stated the decision signed by the Justices Daniel Erbetta, Roberto Falistocco, María Angélica Gastaldi, Rafael Gutiérrez, and Mario Luis Netri. Thus, the highest court adopted a precedent-setting definition for future decisions.

The municipality must appeal to the Supreme Court of Justice of the Nation if it wants the first instance measure reviewed.
